hydrostatic systems produce a lot of heat, and the fan helps to dissipate the heat. It may not be the best design, but it is necessary. I think a skid plate could be fashioned while still allowing airflow. A lot of hydrodrives have fans, but not all of them are in such a precarious location.

Pull it apart and see what you got- you should be able to tell what shape the brake pads are in, and if there is an oil leak- that may cause you problems, too. Brake pads on tractors seem to last forever- I'd look for an oil or grease source, first.
