I think OP is lucky the tractor was picked up promptly and is being taken care of by Kubota/the dealer. Start pointing fingers and holler at this point can turn ugly quick. It’s unfortunate, but such is life.

Still curious as to where/how the tractor is stored…I could throw another log in the fire

first thing you want to do in order to protect yourself is to get a copy of the original (dated, and signed by dealer and by you) predelivery inspection (PDI) checklist. You should have signed that when you did the paperwork. If not, they (dealer) could easily cough one up for you to sign now, backdated. If they don't have the one (or a copy) you signed when you took delivery of the tractor, then there's strike one. In other words, there is no proof that they properly did the setup and PDI.

If you have the original PDI, and everything's checked, then it opens up possibilities. Maybe the dealer can say "you hit something"--in which I'd say "where's the evidence". Or they could say, "it's been vandalized"-which I'd say where's the proof of that (did you find the drain bolt? Look at the oil trail, shouldn't be too terribly hard to locate. Does the drain bolt have a copper washer stuck to it? Does any part of the bolt have wrench marks on it? Does the drain bolt have any evidence of it being struck by foreign object debris?

And lastly, for now, an engine replacement isn't the end of the world. They're not terribly hard to do, and if the dealer has any worth, they can knock it out in a day (after they have the supplies and parts on hand) and you'll have your brand new tractor again. The bigger issue, is that you have lost confidence in the dealer and with Kubota in general, and with that in mind you can call kubota's customer service and vent. They need to know about the situation before the dealer calls their tech support if possible.

Have you seen dealer lots in the past year or so?
I was going to say the same thing. Where you gonna get a loaner from when ain't nobody got anything to loan? That's one reason the service & repair business has been pretty hot this year.

I would want a new machine and tell them to deliver it tomorrow! Why should you have to go with no tractor while it sits at the dealer for God knows how long.
And the Dealer would pull out the warranty sheet that was signed by the customer and tell him to read about the Liability and Limitations.
Kubota is not going to hand out a new tractor, they will repair the one he has.

I just did my first service/oil change a bit ago. Mine were essentially painted in place. No idea how the OPs could come loose if they had as much paint on them as mine.

it did not perform as designed nor as it was represented.

I‘m not a lawyer nor an expert on lemon laws. I am only suggesting it as a possibility to be explored.

In most instances to qualify under a lemon law your vehicle must only have an unreasonable repair history under the warranty, including (but not limited to) 3-4 repair attempts for the same problem, 6 repairs total on the vehicle, or 30 days out of service by reason of repair.

Well, there you go.
And thats where you will get the lawyers involved and it may not be in your best interest. The drain plug was in it when it left the dealer when sold. It wouldn’t have made it through set up,delivery, and 5 hrs of use if not. Whats the legal fees worth to try to prove what happened to said drain plug. The manufacturers have deep pockets. In THIS particular case, Id take the new engine under warranty and go about my day.

edit: Kubota and or dealer is doing OP a huge favor in this case in my opinion

I think there’s sufficient reason for the dealer and Kubota to see a better pathway for all concerned to give the OP a different tractor and get on down the road.

Why the dealer?
Because the dealer is the representative of the mfr’r and the person who sold the OP on THIS tractor.

Why are you trying to get Me to develop a legal case here on an internet discussion forum? I’ve already revealed my level of expertise in this matter and have no inclination to keep up this tit-for-tat so you can feel supreme about this. I’m only attempting to get the OP to expand his thinking on this incase it begins to go south on him.

Why are you so much more on the side of a dealer you don’t know?
