seems that brake is on when cold and starting out

If the brake is actually not applied you're probably seeing low power due to the cold engine and cold hydraulic fluid. Start it up then head back into the house for another cup of coffee. Your tractor will love you for it. If you can't do that run it in low range for awhile.

I have noticed when I accidently have the tractor in High gear it runs like the brake is on.

ya Roadworthy that could be the problem,its my third winter with it and i never had it do this before.the brakes are not on and it runs great after.
