The states make out on these fees also because most raise the sales tax collected if placed before tax or increase the fee if added after tax.

Doesn't EVERY US bill say 'legal tender' or something like that ?

A merchant must provide clear disclosure to the merchant’s customers of the merchant’s surcharging practices at the point of interaction, which shall include the amount of the surcharge and the dollar amount of the surcharge on the transaction receipt provided by the merchant to its customers.

NOTE they have to POST they ARE surcharging as well as the amount !!!

THAT.....is apparently, in the province of Ontario, Canada!

I think you're right in your estimate of approx 3%.

Strangely, I didn't think it was legal for merchants to charge additional $ for credit card transactions...yet, you see it all of the time?

It's a play on words, They don't charge extra if you use a credit card but can offer a discount if you pay using cash.

The biggest problem I see with tipped employees is that they don't always declare the cash tips in their totals for the day. To put it bluntly, they don't want to pay taxes on the cash like the rest of us who are not paid in cash and have to pay 100 of the taxes on what we earn.

When I eat out and pay with CC …I Always leave the waiter’s Tip in CASH…. so the employee can get max benefit as well as use their own scruples whether or not to share or report it.

The small family cafe where I like to have lunch will reduce the “tab” if Cash is paid instead of CC. No particular mention is made anywhere of that policy….the customer will discover that at the cash register.

In the early Mastercard Merchant Agreement, 'merchants' aka 'stores' could NOT have different prices for CC vs cash. If they did, and got caught, MC dropped them as a 'merchant'.
It's also against policy to LIMIT what you can put on a CC. if you have a $20K limit, and have used 4K, you CAN put $16K onto your card. If a merchant says 'sorry, we have a 5K limit, you cal 1-800-mastercard and they will set the merchant straight. BTDT.

Only problem I have, and it’s mostly with restaurants, is displaying a price, then adding labor fees, different prices for different payment methods (unless clearly stated and not in fine print), and/or adding any other miscellaneous fees regardless what they call them. Doesn’t matter if I’m ordering the #12 value meal or the 16oz ribeye, I just want to know what the dang thing costs. I know to tip at the steak house and not at the drive through hamburger hut so I can figure that part out myself, but other than that just tell me how much it’s going to take to get out the door without a fight.
