Not to start an argument here but, when on the phone at the dealers it was suggested by the insurance company that I get the insurance before my tractor even left the dealers yard. That way if something should happen and my brand new tractor get damaged or worse I'm covered prior to the tractor even leaving the dealers yard. At least that was how it was explained to me.Frank

Did anyone read the first sentence of the original post where the dude clearly stated this is NOT his first rodeo with tractors and other machinery through out his life?!?! Its my understanding that this whole cluster fuck the dude is going threw is NOT a ROOKIE mistake, that he has a real safety problem with the tractor.

Regardless of any possible type of insurance fraud or NOT everyone has CONSUMER rights that are designed to protect them. KTAC can deny a insurance claim all day long or they can honour it and pay the damages.

Every so often a bad egg slips past QC and end up being sold to the public. It happens with everything which is why Consumer rights and laws are set in place to protect people. Ever heard of the Lemon Law?

Getting insurance in the beginning is the right choice. If he bought insurance before the stupidity started they would have covered all the damage!

I think your missing the real point here, read between the lines, he's just trying to get out of paying for a tractor that he wrecked because of his incompetence, ignorance and stupidity not because of a failure of the tractor!. He didn't try and get it fixed till after the third time that it was wrecked, and did $9500 in damage! If I rolled my tractor because of a bad transmission I would have been on on the phone with a lawyer and the dealer before I ever tipped it back on its wheels!
My take on it is that he was having a party and they took the tractor out on a joy ride and totaled it!
Don't get sucked in by a scam artist sob story!!!!

That's some freaky ghost shit right there, if my tractor sat for a week on level ground and then all the sudden threw itself into a tree I'm calling for a exorcist. The guy lists NYNY as his address maybe hes close to Amityville.



also pretty sure i have never used the clutch on my B series HST to change ranges?

This is one of those 'believe it or not moments'.....believe it or not , today I had 14 pallets delivered so I unloaded the truck in one spot then later was moving the pallets into a storage building , on the way to the storage building there is a small hill in the driveway, while going down on one of the trips. The side pocket on my pants catches on the gear shift lever, I was traveling in Med speed. When I moved slightly heading down hill, the shift lever was pulled into 'N'...the tractor immediately started to take off down the hill. My foot went right to the brakes...I stopped, shifted back into gear and continued on...is it possible that this same thing happened to 'whats his name'...and he just wasn't brite enough to hit the brakes ??

I can't believe the engineers were not smart enough to provide a 'lock-out' for neutral.

Yeah, more 'safety features' is what we need! :rolleyes:

I go up one hill that is so steep that when I crest the top the front wheels leave the ground until the mower goes over the top. If I had a tractor that went to neutral in the middle the the slope.........I'd be screwed.


Not a big deal to pull in the lever to get past neutral. And no, I'm no fan of safety features.

I recently purchased a B3200 within the last 6 months. I have driven tractors and other machines throughout my life, so I am not totally new to the concepts of machanics. That being said, I purchased a brand new B3200 series Kabota. I was using it to mow my lawn and small field in front of my house. The field happens to be on a slope, but I have mowed the slope before with my lawn mower without incident. The problem that I encountered 3 times with this particular tractor was it seemed to go into a neutral position on its own and take off out of control. My first experiance it was in med speed with the hydrostatic and I put the clutch in and shifted into low range with the 4x4 engaged as well before I approached the slope downward. after I let the clutch out the tractor took off like a train out of control. Luckly I was able to stop half way down without incident. I figured it was my fault and was getting used to the tractor. A month or so went by and I was mowing uphill on the same slope. I had it in low range and 4x4 was engaged, I was crawling slowly to avoid accidents. To my surprise the tractor self engaged into neutral and went backwards at a high rate of speed going out of control. The outcome was good for me and bad for the tractor. I rolled it and luckly I was strapped in and the rollbar did what it was supposed to do. the 3rd time this happend was when the tractor was parked on somewhat level ground, and it had been parked there for about a week. I had a party and several people witnessed the tractor roll backwards at a high rate of speed into a tree. Luckly nobody was behind it. The tractor is wrecked and the dealership gave me an estimate of 9500 dollars. From their tone of voice they were not interested in warranty nor were they interested in my story or my safety. They informed me that they did not look at the transmission when they gave me the estimate because the tractor was not running. They also said if it was a warrenty issue they would not cover any of the cosmetic damage to the tractor. Can ANYONE out there give me some advice? Has anyone ever heard of these hydrostatics having problems? Can anyone point me in the right direction?
Not ignoring the blogging here and trying to help you.

First do all, do verify that your sleeve did not brush against the shifter either moving around or getting on or off. If that is not the case. Do this:

DEMAND that the factory rep meet you or agree to inspect the tractor. Get whatever is said or imparted to you IN WRITING. If not satisfactory, contact your State bureau of consumers affairs via certified letter stating clearly the problem and your expected results. Clearly, to me, the results are A PRODUCT THAT IS FIT FOR THE PURPOSE FOR WHICH IS INTENDED.

Barring that, you can cite the Uniform Commercial Code which applies across our land. The provisions you are looking for within it are "fitness for purpose" and "latent defects." This might involve a claims court but it will work. Send the claim to Kubota's receiving agent. That will get their attention.

Now you must act as you only have a reasonable period of time to make your case. Generally, this is defined as 6 months.

Running tractors on uneven and steep ground is dangerous. 'Most' of us humans learn that pretty quick and adapt to the situation.

Of course, a Kabota B3200 may have more special controls than a Kubota B3200 which us Kubota owners don't know about.
