So far all we are hearing about are the civil claims. I am wondering if there will be criminal charges filed next. Attempting to shift ownership to family members to protect assets is a criminal activity when it is done immediately before or during a bankruptcy filing. With state criminal charges and convictions, you have a chance of parole, but with federal sentencing, if the judge gives you 10 years, you will serve the full 10 years. Bankruptcy is a federal proceeding in federal courts. Just lying to a Federal agent can get you 3 years in a federal prison. Don't believe me, then ask Marth Stuart.

Did you have to pay all upfront?
I'll probably know today if it hits my card. Just ordered yesterday. Chances are, it does. I vaguely recall another OTT member recently ordered a BB and they did.

Another 'biggie' , is that sales were via the Internet, Federally regulated, and 'cross state boarder' sales is another possible set of charges, especially if feds go sale by sale by sale by.......... !!!

It would seem the company could potentially resume operations under some court appointed trustee independent of prosecution of those guilty of mismanagement and using the company as their personal piggy bank. It seems there should be enough recoverable assets i.e. lake house, etc. including things illegally transferred to go a good way towards making the secured creditors whole. I doubt this will happen of course since there is little interest in doing the right thing and protecting the customers and employees of what should have been a viable company.

So you ordered something as of 2/21/2024? I would think that's definitely heading into the fraud area then, because based on court orders and such, it seems pretty clear they have ceased production and know they are not going to resume.

Were you able to actually speak to anyone there?

That order was with Homestead not EA.

That said the EA website is still up and running. I could put things in my cart and was offered a checkout and ostensibly a payment. I defered and hit the empty cart button instead.

I looks like TC is still building his pyramid.....

hmm, 8mill for loan, 1.5m for LOC, 2M for contrator, wellover 10 million owed PLUS unknown 'payables' for steel, nuts and bolts, hydraulics, office/shipping,heat,hydro.
It's not only the buyers of products but the small suppliers that will never get a penny. Assets like steel and stuff get sold off to pay back the secured creditors. Wonder if the TESLA is in EA's name ?

Interesting viewpoint. They may have made an exceptionally good product but the owner was stealing his customers, his banks, and the company blind to enrich himself. I dont consider that a "successful business".

Does anyone know if they are still making product? Are workers still going into the plant?
From folks who live in the area report the plant is closed, workers are no more. It's also been stated one person saw a load of steel leaving the plant a couple of days ago.
